Vladislav:  The truth behind the man!


To my knowledge, and I read up on this recently, it is illegal to use something in a meta tag or register it in search engines IF the site is directing traffic to another site, especially if you are trying to sell something (like me).  Vladislav, domain owner gothicunderworld.com, claims that this is freedom of speech, though the material that was on here was copywritten.  He complained about some people using HIS copywritten material, and I am unsure as to whether or not he actually has the registration form.  I paid my 30 bucks and I'm registered with the Library of Congress.  HE FIRST AMENDMENT IS NO EXCUSE FOR INFRINGEMENT!  And my freedom of speech permits me to state the facts of what happened, as long as I don't slander.  Here is what happened, along with the details...
WHAT WENT DOWN!!!

In 2001, I requested that my site be removed from the website.  If you visit the link by copying and pasting in your browser or clicking the link if it works, you will see that I have asked this girl to remove me.  She admits to it herself.

I asked Vlad to take it off since emailing this girl wasn't working, and he said yes, he would.  I wrote back and thanked him.

Years later, LO AND BEHOLD what I come across on a search engine!  My name, destined to stay there for eternity on a derragotory website!  So I emailed Vlad and asked him to take me off once again.  He said SURE!  Here is what happened...Read the email sections to see how Vlad disregarded my copyright and other legal issues, especially after he claims that his webmistress is a lawyer and that "copyright infringement is wrong."  Besides that, he said he WOULD take it off and went back on that promise.

 


 

The Emails:

I wrote to Vlad and asked that my link be removed.  I don't have that email, but here is his which proves that I asked.  Anything in BLACK and BOLD letters was NOT in the email, just my little side comments...

DOCUMENTED EMAIL 2 (FROM ME TO VLAD):
First of all my link has NOT been removed from the website. This is NOT the first time ive asked. I've asked the girl who owns the website (who mentions that in the link's description which is PROOF that I've asked, and she's making a mockery of it by trying to make it sound as if I'm so pathetic by my request) when her site was running, and I've asked you on more than one occassion, at least two that I can recall and only one that is documented. You whine because someone else infringed upon your copyright and have everyone sending them emails about how "copyright is wrong" and blah blah blah, which you probably don't even have an official copyright registration and you disregard my own copyright and allow it to be used even after I've asked it to be taken down. For one, I want to say that I'm looking into getting a lawyer and I've discussed law with a few different ones, so you better hope your Devil's Geisha knows a lot about the law as her description states. I have a legal standing in that I am trying to get a start as an author and I AM published, and the site keeps popping back up in searches. Last time you said it had been removed and I was stupid to not have checked. I am trying to establish my name, and by having the link up, it is hindering hits on my OWN website. It's illegal to use anything thats a copyrighted name and not only that, but the site was copyrighted and THAT in itself is illegal.

You have one week to remove my link and until then I'm still talking with some lawyers until I find one that I approve of. I've got my copyright documents as proof and I'm saving these emails.

If you can't get a hold of her or take the link off, I'm seeing what I can do about my copyrights and so just hope you won't be held responsible for her mistake.

That's the second email.  TELL ME!  DOES THIS SOUND LIKE A THREAT?!?!  I told him what I was planning.  I do know people who study law, are into this area, and my brother is dating a DA so I know a little something about it....lol

DOCUMENTED EMAIL 3 FROM VLAD (To Me)

Because of the context of this email, and because of your near threats, the link will stay. I am NOT responsible for the content within hosted site on any of my servers, therefore I am now suggesting that you maintain your flow of emails and contwct to the owner of http://gothinthenight.gothicunderworld.com as opposed to harrassing ME. As for copyrights, the webmistress of GothicunderWorld.com (not the site in question, incidentally) is actually a lawyer. You may consider backing off with further threats.

Guess it was a threat...According to Vlad, anyways...hmmm...Did I miss something here?  It was also harrassment...When it comes to demanding that your property be taken off of a website, that isn't harrassment.  Vlad was only offended because he didn't expect me to become demanding and "threatening" and scary.  As I said, it isn't harrassment...It's just defending my rights and since asking NICELY wasn't working, I explained my rights and became merely ASSERTIVE.  I guess he couldn't tell the difference.

EMAIL 4 From Me:

Well that's fine, but you'll be hearing from mine then. As a owner of the domain in its entirity then yes you ARE responsible for the content. If you don't know about the content then no you're not, but because I have reported it then YES it's your problem. I don't know what else to do. I've asked politely, I've sent you copies of the last emails I was able to send to her, and I've asked you as well. I was NOT threatening you, but I was giving you time to remove my link since nothing else seemed to work, and I am considering taking more serious actions. It was just a heads up so that you know what to expect, and I'm sure that any judge will find your last comments VERY mature. Not only that, but because I have reported the offensive material which was not only offensive, but it was about ME and MY link, well, you have an obligation to delete it and were apparently too lazy or your web design skills aren't as great as you think they are.

At any rate...know that this was not a threat but a notification, and I sent the last email as kindly as I could have given the circumstances.

LAST EMAIL RECEIVED FROM VLAD:

Actually,  as the owner of the domain that HOSTS "subdomains"  I am released
of all content responsibility of anything we host.  You can check this leal
aspect simply looking up "Copyright Infringements  within Sub-domian
hosting,  wherein TOS's are fully presented"

I could very easily login to the users'  database and make the changes
myself,  but I'd actually be infringing on their "right to freedom of speech
and content representation".

I've also,  you should note,  contacted the person responsible for that
particular site to no avail.  I have records of ALL activity on all 4 of our
servers,  as well as the emails,  which of course is only the 3rd (counting
this one)  that I've received from you.

Not to make things more difficult for you however,    as I fully underatand
and respect the fact that you're an aspiring writer,  and do not wish you to
become a victim of  "internet slander".

Though I do not personally share the same interests or views or even
opinions of any site we host,  I simply cannot just login to a users'
personal webspace without taking the appropriate and LEGAL steps neccessary
to even do you this one favour.  Granted,  I'd simply like to wipe the
referance on her site.  Rest assured,  I most certainly will.

If however,  you still feel it is neccessary to approach this on a legal
level,  I've already forwarded the emails and the recorded data to the
office of  Pénélope Jolicoeur (Devil's Geisha)  of Frazier, Milner of
Canada.

If you require correspondance with her,  I'd suggest asking your "lawyers"
to contact her directly as this matter has already been taken up on the
legal avenue here.

Not to be a prick,  but there are quite simply,  much easier ways to do
things,  and I'm sure your lawyers have already informed you that your
previous email to me was actually illegal,  in terms of wording and
phrasing.

Instead of paying a pricy lawyer, I decided to re-construct this website to explain what went on.  That was my best alternative of all of the choices strewn out before me.  Oh!  And don't forget to read Mr. Vlad's Soap Box on Copyright infringement! *cough*   hypocrite   *cough*      HERE'S THE LINK! :) ENJOY!

Doesn't feel too good, does it?  Hmmm....Maybe we should send Vlad a little email and tell him that copyright infringement applies to EVERYONE, not just Broken and Nexus.  So if you would like to send Vladislav a little piece of your mind, DO NOT slander him, call him names, swear, etc, but let him know that this treatment is WRONG, especially since he was in a similar predicament.  If he can do it to Broken and Nexus, then so can you...
